style=\"color: #000000;\">The present General Sales Conditions (GSC) define the commercial relations between on the one hand :<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>The company &#8221; Transport Prestige 69 &#8220;.<\/strong>SASU with a capital of \u20ac1,500, registered in the Lyon Trade and Companies Register under the number SIREN 814.650.016, whose head office is located at 1 Rue de Londres, 69140 Rillieux La Pape, Code APE 4932ZA represented by its manager, hereinafter referred to as the &#8220;Provider&#8221;;<\/span><\/p>\n<p><span style=\"color: #000000;\">And on the other hand :<\/span><\/p>\n<p><span style=\"color: #000000;\">Any individual or legal entity, hereinafter referred to as &#8220;Customer&#8221;, who acknowledges having read these G.S.T. and accept all the terms, waiving any other text.<\/span><\/p>\n<p><span style=\"color: #000000;\">CGV: PROVISION OF SERVICES<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 1 &#8211; Purpose<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">The purpose of the services offered by the Service Provider is the transportation of persons for remuneration by means of a vehicle with a driver, commonly referred to as a TAXI or VTC, within the framework of a transfer or provision of services.<\/span><\/p>\n<p><span style=\"color: #000000;\">Excluded are items requiring specific approval for their exercise, not held by the provider.<\/span><\/p>\n<p><span style=\"color: #000000;\">The qualification of the subject matter of a provision of service remains at the discretion of the Provider.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 2 &#8211; Benefits<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Transfer :<\/span><\/p>\n<p><span style=\"color: #000000;\">Corresponds to the transportation of one or more persons from a pick-up location to a destination location.<\/span><\/p>\n<p><span style=\"color: #000000;\">The number of people transported is limited to the capacity of the vehicle (3 seats during the covid period, 4 seats at the end of the covid); the transport of goods (luggage, parcels, &#8230;) is included within the capacity of the vehicle (volume and weight).<\/span><\/p>\n<p><span style=\"color: #000000;\">The access to the charging sockets (USB) of portable devices (phone, tablet,&#8230;) is included in the additional service<\/span><\/p>\n<p><span style=\"color: #000000;\">Provisioning:<\/span><\/p>\n<p><span style=\"color: #000000;\">In addition to the services offered for a transfer, the provision includes the availability of the vehicle and the presence of the driver between two or more transfers or for the duration of an event (seminar, wedding, etc.) requiring one or more trips.<\/span><\/p>\n<p><span style=\"color: #000000;\">In addition to the above, a refreshment per person (mineral water) is included.<\/span><\/p>\n<p><span style=\"color: #000000;\">Driver:<\/span><\/p>\n<p><span style=\"color: #000000;\">The chauffeur service corresponds to the operation of the driving license and the professional card in case the Customer has a vehicle.<\/span><\/p>\n<p><span style=\"color: #000000;\">The service of driver also implies the convoying of vehicles.<\/span><\/p>\n<p><span style=\"color: #000000;\">These services include conditions to be contracted in advance.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 3 &#8211; Commitment<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">The Service Provider undertakes to use all its know-how in order to provide a comfortable and safe transportation of the Customer and the passengers accompanying him, according to an itinerary established to be optimal in time and\/or mileage, subject to normal traffic conditions.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Service Provider also undertakes to respect the absolute confidentiality of the Customer and the people around him, whether they are related to the service or not.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 4 &#8211; Reservation<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Any reservation implies the acceptance without reserve of the present general conditions of sale.<\/span><br \/><span style=\"color: #000000;\">The Client and the Provider agree to abide by all of the terms cited in this Agreement.<\/span><br \/><span style=\"color: #000000;\">No changes shall be made to the above terms and conditions except by prior agreement between the parties.<\/span><br \/><span style=\"color: #000000;\">The present contract would be suspended by the platform  <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a>, the pick-ups may be postponed or cancelled as of right and without compensation (this includes in particular the reimbursement of the race) of any kind in all cases recognized as force majeure (event external to  <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a> such as disruption of traffic routes, bad weather, demonstration, d\u02bcaccident, breakdown or malfunction of telecommunication networks, shortage of manpower or materials &#8230;<\/span><br \/><span style=\"color: #000000;\">The contract is only deemed concluded once the order is placed through the various communication tools delivered by the <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a> platform.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Reminder of Article 1:<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">By using the services of  <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\"  the customer is presumed to have taken knowledge of the present General Conditions of Sale and to have fully accepted them either by tacit way (by having ordered orally by telephone (with the module on the site and application generating an audit report acting as electronic proof of acceptance of the T&amp;Cs, or by means of an electronic signature meeting the European regulation of the EiDAS subcontracted by the company and partner  <a style=\"color: #000000;\" href=\"http:\/\/cm.com\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/CM.COM&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw1mc3tdoz4ZvvDt1G2YhLN9\">CM.COM<\/a>  and DocuSign.<\/span><\/p>\n<p><span style=\"color: #000000;\">All reservations for a chauffeured car are mandatory and must be made at least 24 hours in advance through our  <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a>  or on our online chat provided by the partner company Zendesk through the tool Zopim. at the last minute by phone depending on availability; in this case the driver reserves the right to set the price according to the VTC law in force and the TAXI price decree.<\/span><\/p>\n<p><span style=\"color: #000000;\">Particularity for a pick-up in train station and airport:<\/span><br \/><span style=\"color: #000000;\">  &#8211; As soon as you arrive, turn on your cell phone, it is the customer&#8217;s priority to contact the driver.<\/span><br \/><span style=\"color: #000000;\">  &#8211; The driver reserves the right to postpone the pick-up according to the terms and conditions stipulated in the contract.<\/span><br \/><span style=\"color: #000000;\">  &#8211; Please note in &#8220;additional information&#8221; when booking the flight or train number or any other information to facilitate the pick-up or to personalize your trip (welcome sign, concierge, music playlist, still water, sparkling water, etc.).<\/span><\/p>\n<p><span style=\"color: #000000;\">For flights, if you don\u02bct have checked baggage, the 15 minutes of free waiting time included in the fare is usually enough. However, if you need to retrieve checked baggage and\/or if you are coming from a non-European destination, the time to exit the aircraft, baggage retrieval, and possible law enforcement checkpoints require fairly long delays.<\/span><\/p>\n<p><span style=\"color: #000000;\">To avoid having to pay a wait, we recommend that you add a 30-minute buffer for your pickup.<\/span><br \/><span style=\"color: #000000;\">A 30-minute beat is allowed to the driver from the time the order form is picked up.<\/span><br \/><span style=\"color: #000000;\">For example: if your pick-up time is 12:00, the actual pick-up time will be between 12:00 and 12:30.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Reminder:<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Every 45 days the invoice will be increased by 4.16% as provided for in l\u02bc Art L 441-6 of the Commercial Code.<\/span><br \/><span style=\"color: #000000;\">And this is excluding the blow of bailiff management fees and d\u02bchonoraria d\u02bcavocat, disbursements and costs. The rate of delay for professionals is freely set by the merchant in accordance with the law. Payments are in cash.<\/span><br \/><span style=\"color: #000000;\">Cash payment: the customer has the obligation to pay for the good or service on the day of delivery or performance.<\/span><br \/><span style=\"color: #000000;\">The interest rate provided for in the GTCs is generally the semi-annual key rate (refinancing rate or Refi) of the European Central Bank (ECB), in effect on January 1 or July 1, plus 10 points.<\/span><br \/><span style=\"color: #000000;\">Example: 10.00% (0.00 + 10) for penalties due since July 1, 2019.<\/span><\/p>\n<p><span style=\"color: #000000;\">Cash payment: All orders must be paid in advance and will be counted as a deposit of the estimate only. The order is paid in advance either as a deposit or as a guarantee.<\/span><br \/><span style=\"color: #000000;\">The rate of payment of the l\u02bcacompte is 100% of the price of the \u00e9stimation of the service, including VAT. (Article L. 114-1 of the Consumer Code).<\/span><\/p>\n<p><span style=\"color: #000000;\">Thus, the customer has the obligation to pay in full for his or her &#8220;return trip&#8221; in the form of an estimate deposit, and the remainder of the purchase order or invoice incorporating potential outbound or return trips.<\/span><br \/><span style=\"color: #000000;\">Payment on board is considered as a commercial gesture and postpones the payment of the outward journey until the service is provided. If the client wishes to cancel the trip, he\/she will have to pay the full price of the estimated trip.<\/span><br \/><span style=\"color: #000000;\">For payments on board a guarantee will be required (see Article 3 of said contract), this is a bank imprint that will guarantee a customer\u02bcs ability to pay the potentially payable fees stipulated on said contract.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 5 &#8211; Quotes<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">For services that are not covered by a reservation form, a preliminary estimate may be requested, established free of charge by the Service Provider based on the information provided by the Customer.<\/span><\/p>\n<p><span style=\"color: #000000;\">In this case, the reservation is confirmed by returning the quotation to the Service Provider with the Customer&#8217;s signature preceded by the date and the mention &#8220;Good for agreement&#8221;.<\/span><\/p>\n<p><span style=\"color: #000000;\">Unless specifically stated otherwise, the validity period of a quotation is ten (10) days from the date of issue.<\/span><\/p>\n<p><span style=\"color: #000000;\">A deposit of thirty percent (30%) of the total amount including all taxes (T.T.C.) of the estimate may be requested<\/span><\/p>\n<\/p>\n<p><span style=\"color: #000000;\"><strong>Article 6 &#8211; Prices<\/strong><\/span><\/p>\n<\/p>\n<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0sf6QSgw-jg9PDIUXueR1q\">www.transport-prestige69.fr<\/a> fixes the price of the service according to the information provided by the customer.<\/span><br \/><span style=\"color: #000000;\">Exclusively on reservation and at a predefined estimation price. These rates are for a normal trip, excluding the cost of reservation fees, other or night rates, (see the article detailing the potentially eligible fees).<\/span><br \/><span style=\"color: #000000;\">  The prices are expressed in euro (\u20ac) and inclusive of all taxes (T.T.C.).<\/span><\/p>\n<p><span style=\"color: #000000;\">The rate of Value Added Tax (VAT) applicable is 10% for transport services and 20% for driver services and the transport of parcels<\/span><br \/><span style=\"color: #000000;\">The basic price (including VAT) for transfers is calculated from the number of kilometers to be covered and the time needed to cover them, as well as a pick-up cost.<\/span><\/p>\n<p><span style=\"color: #000000;\">Regulated rate prefectoral decree number <strong>69-2022-01-26-00001<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Return<\/strong> <strong>trip<\/strong> with a client<\/span><\/p>\n<p><span style=\"color: #000000;\">Rate <strong>A<\/strong> <strong>0,92 \u20ac<\/strong> \/ Km ( from 7h00 to 19h00 )<\/span><\/p>\n<p><span style=\"color: #000000;\">Rate <strong>B <\/strong><strong>1,38 \u20ac\/<\/strong> km ( from 19:00 to 7:00 on Sundays, public holidays, snowy roads )<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Going <\/strong> with a client and returning empty<\/span><\/p>\n<p><span style=\"color: #000000;\">Rate <strong>C <\/strong><strong>1,84 \u20ac\/<\/strong> Km ( from 7h00 to 19h00 )<\/span><\/p>\n<p><span style=\"color: #000000;\">Rate <strong>D <\/strong><strong>2,76 \u20ac<\/strong> \/ km ( from 19h00 to 7h00 Sundays, holidays and snowy roads )<\/span><\/p>\n<p><span style=\"color: #000000;\">assumption of responsibility : <strong>2,5\u20ac<\/strong>.<\/span><br \/><span style=\"color: #000000;\">Immediate booking<strong>:2\u20ac<\/strong>.<\/span><br \/><span style=\"color: #000000;\">Reservation in advance: <strong>4\u20ac<\/strong>.<\/span><br \/><span style=\"color: #000000;\">Waiting hour or slow walk : <strong>36,60\u20ac<\/strong>.<\/span><\/p>\n<p><span style=\"color: #000000;\">The basic price (including VAT) for the provision of services is calculated on a flat-rate basis for an hourly period and for a maximum mileage. The basic price (including VAT) for the chauffeur&#8217;s service is per indivisible hour.<\/span><br \/><span style=\"color: #000000;\">The prices communicated, except specific mention, do not include the expenses of access to the closed and paying sites (tourist or others) for the vehicle and\/or the driver, nor the additional expenses (restoration, lodging,?) for the services said long duration.<\/span><\/p>\n<p><span style=\"color: #000000;\">All the basic prices are increased by 50% for all services (called night services) performed between 7pm and 7am.<\/span><br \/><span style=\"color: #000000;\">Reference prices are subject to revision without notice.<\/span><br \/><span style=\"color: #000000;\">Fees payable under the terms of the T&amp;Cs :<\/span><br \/><span style=\"color: #000000;\">Vehicle damage, parking fees, waiting fees, travel fees, approach fees outside the ZUPC zone, night fees, icy or snowy roads, detours, regulation fees, vehicle range, reservation fees, cancellation fees, postponement fees, pet fees and valet or concierge services, additional luggage fees for up to 3 pieces of luggage per person, toll fees, regulation fees for new trips or requests for services of any kind.<\/span><\/p>\n<div class=\"yj6qo\"> <\/div>\n<p><span style=\"color: #000000;\"><strong>Article 7 &#8211; Billing<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">For each service, an invoice can be established by the Provider at the request of the Customer.<\/span><\/p>\n<p><span style=\"color: #000000;\">Within the framework of contracted services (account customer) and renewed by periods higher than one month, the invoicing is established for each month, at the last day of the said month.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 8 &#8211; Payment<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Payment can be made online at the time of booking, by credit card (payment terminal on board the vehicle) or in cash within the legal limit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Payment shall be made at the latest at the end of the service and in cash; or thirty (30) days net after the date of invoice and in cash for contracted and renewed missions (account customer).<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 9 &#8211; Late payment penalties<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">In accordance with the Law, any delay in payment shall be subject to a fixed compensation of forty euros (\u20ac40.00) and to late payment penalties on the unpaid amount, calculated and invoiced on the basis of an interest rate of twelve percent (12%) per year.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 10 &#8211; Cancellation<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">A reservation cannot be cancelled by the client.<\/span><br \/><span style=\"color: #000000;\">Any amount advanced by the customer by cash, check, credit card or online payment is considered a deposit. If the customer refuses to complete the reservation or registration and decides to cancel the race the amount will be lost in its entirety under the l\u02bcarticles L21 4-1 to L214-4 of the consumer code.<\/span><\/p>\n<p><span style=\"color: #000000;\">If a customer orders and the platform  <a style=\"color: #000000;\" href=\"http:\/\/www.transport-prestig69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.transport-prestig69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw3KnqL0v53nqGdvuPvVfbQo\">www.transport-prestig69.fr\/<\/a>  (Transport Prestige69\u00a9) could not honor a service within a framework of major force (quoted on the aforementioned contract),  <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a>  (Transport Prestige69\u00a9) will be able under a commercial gesture to propose the reimbursement of the race in the form of a non-refundable voucher in the form of cash.<\/span><\/p>\n<p><span style=\"color: #000000;\">A credit valid for an unlimited period of time. The platform <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a> (Transport Prestige69\u00a9) does not reimburse any amount advanced in cash.<\/span><br \/><span style=\"color: #000000;\">Payment on board is considered as a commercial gesture and postpones the payment of the outward journey until the service is provided. If the client wishes to cancel the trip, he\/she will have to pay the full price of the service.<\/span><br \/><span style=\"color: #000000;\">In case the customer refuses to pay the invoice or order: the platform reserves the right to collect the amount of the deposit which will be equivalent to the amount of the fare as well as fees and compensation in addition. The compensation will be inspired to 50 to 100% of the price of the l\u02bcamende that the law provides in case of tampering, 7000\u20ac, under the article 313-5 of the Penal Code.<\/span><br \/><span style=\"color: #000000;\">Any amount paid in advance on <a style=\"color: #000000;\" href=\"https:\/\/www.transport-prestige69.fr\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.transport-prestige69.fr\/&amp;source=gmail&amp;ust=1660288962588000&amp;usg=AOvVaw0wrdS7bHZMyhlhCXFPmNpq\">www.transport-prestige69.fr\/<\/a> (Transport Prestige69\u00a9) or directly to an agent or manager, will be considered as a deposit regardless of the payment method used.<\/span><br \/><span style=\"color: #000000;\">Reminder:<\/span><br \/><span style=\"color: #000000;\">L\u02bcarticle L214-1 to L214-4 of the Consumer Code which states that:<\/span><br \/><span style=\"color: #000000;\">A deposit is an amount paid in advance by a customer when making a purchase. Force majeure<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">In the event of non-completion of a mission or delay in its execution, the Provider&#8217;s liability shall not be engaged in all cases of force majeure as defined by Article 1148 of the Civil Code:<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8220;any external, unforeseeable and irresistible event&#8221;.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 13 &#8211; Prohibition<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">In the vehicle, it is formally forbidden to drink alcohol, to smoke and to vapourize, as well as to consume any substance that could be considered as psychoactive.<\/span><\/p>\n<p><span style=\"color: #000000;\">In case of non-compliance, the service may be suspended immediately, the price remaining due in full.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 14 &#8211; Obligation<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">In the vehicle and its surroundings, the Customer is required to respect French legislation, in particular the Highway Code that may apply to passengers in a vehicle.<\/span><\/p>\n<p><span style=\"color: #000000;\">Underage children remain under the full responsibility of their parents\/guardians\/carers.<\/span><\/p>\n<p><span style=\"color: #000000;\">Animals must be in a specialized container for transport.<\/span><\/p>\n<p><span style=\"color: #000000;\">In the event of non-compliance, the Provider shall not be held liable in any way.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 15 &#8211; Dispute<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Any dispute must be made in writing and addressed to the Provider by registered mail with acknowledgment of receipt, under penalty of nullity.<\/span><\/p>\n<p><span style=\"color: #000000;\">A dispute does not suspend any condition of payment or late penalties or retention of title.<\/span><\/p>\n<p><span style=\"color: #000000;\">No dispute shall be entertained after seven (7) days from the date of the invoice for the disputed item.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Article 16 &#8211;
